Please carefully read these Terms of Use before ordering our services. By using our website and ordering services, you accept the following terms in their entirety.

2. Subject of Service

FIGURA FIT TRADE (hereinafter: "Service Provider" or "We") provides personalized meal plan creation services (hereinafter: "Service") through the website nutrifit.guru.

2.1. Service Description

The Service includes:

  • Creating a personalized meal plan based on data you provide (age, weight, height, health status, dietary preferences, goals, physical activity level)
  • Preparing documentation in PDF format containing a detailed meal plan tailored to your needs
  • Delivery of the plan via email to the address you specify when ordering

2.2. What You Get

After successful payment, you will receive via email:

  • Personalized meal plan in PDF format
  • Detailed meal schedule
  • Nutritional values
  • Recommendations and guidelines for implementing the plan

Delivery format: PDF document(s)
Technical requirements: You need a PDF reader to view the document (freely available for all devices)

3. Ordering Procedure

3.1. Steps to Purchase

  1. Fill out questionnaire - Enter your personal data, physical characteristics, health information and goals
  2. Review order - Check entered data and service price
  3. Accept terms - Confirm that you have read and accepted:
    • Terms of Use
    • Privacy Policy
    • Statement about loss of right of withdrawal after delivery of digital content
  4. Payment - Transfer to bank page for secure payment card payment
  5. Order confirmation - Receive payment success confirmation via email

⚠️ IMPORTANT - Consent Before Delivery:

Before making payment, you must confirm that:

  • You request immediate (urgent) delivery of meal plan within 24 hours
  • You understand that after digital content (meal plan in PDF format) is delivered to you, you lose the right of withdrawal in accordance with Article 30, paragraph 1, point 13 of the Consumer Protection Act

This consent is mandatory and represents a condition for service delivery.

4. Prices and Payment Method

4.1. Prices

  • All prices on the site are expressed in Serbian dinars (RSD)
  • Prices include VAT at the rate prescribed by the law of the Republic of Serbia
  • Current prices are displayed on the website
  • We reserve the right to change prices without prior notice, but price changes do not affect already ordered and paid services

4.2. Payment Method

Payment is made exclusively via payment cards through the secure OTP Bank Serbia system:

  • Visa
  • MasterCard
  • Maestro
  • Dinacard

Payment security:

When entering payment card information, confidential information is transmitted over the public network in a protected (encrypted) form. At no point is payment card data accessible to our system.

4.3. Time of Charging

Charging is done immediately upon payment (SMS/Immediate transaction). Your payment card will be charged immediately after successful transaction confirmation.

4.4. Currency and Payment Method

All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). For informative display of prices in other currencies, the middle exchange rate of the National Bank of Serbia is used. The amount that will be charged to your payment card will be expressed in your local currency through conversion at the exchange rate used by card organizations, which cannot be known to us at the time of the transaction. As a result of this conversion, there is a possibility of a slight difference between the original price stated on our website and the one you can see on your payment card statement.

5. Service Delivery

5.1. Delivery Time

Your personalized meal plan will be delivered via email within 24 hours from the moment of successful payment.

Note: Timeframes are calculated in business hours (Monday - Friday, 09:00 - 17:00). Orders paid on weekends or holidays will be delivered on the first following business day.

5.2. Delivery Method

  • The meal plan will be sent to the email address you specified when ordering
  • Document(s) will be in PDF format
  • Email will contain order confirmation and all relevant information

5.3. Problem Receiving Service

If you haven't received the meal plan within 24 hours:

  1. Check spam/junk folder in your email program
  2. Check if you entered correct email address when ordering
  3. Contact us immediately at [email protected] to resolve the problem

Important: We are not responsible for delivery delays due to:

  • Technical problems with your email provider
  • Incorrectly entered email address
  • Spam filter blocking our message

In any case, contact us and we will resolve the problem!

6. Right of Withdrawal

6.1. Legal Right (14 Days)

In accordance with the Consumer Protection Act, you have the right to withdraw from a distance contract within 14 days from the date of concluding the contract, without stating reasons and without additional costs.

6.2. Loss of Right of Withdrawal for Digital Content

However, in accordance with Article 30, paragraph 1, point 13 of the Consumer Protection Act, the right of withdrawal does not exist in the case of:

"Delivery of digital content that is not delivered on a permanent data carrier if delivery has begun with prior express consent of the consumer and with his confirmation of knowledge that he will thereby lose the right of withdrawal."

This means:

  • When ordering a meal plan, you give express consent for urgent delivery of digital content
  • You confirm that you are aware of loss of right of withdrawal
  • After the meal plan is delivered via email, you no longer have the right of withdrawal

6.3. Withdrawal BEFORE Delivery

You can withdraw from the order before the meal plan is delivered to you:

  • Contact us at [email protected] as soon as possible
  • State the order number (OID) and reason for withdrawal
  • Refund will be made within 14 days

Note: If you withdraw before receiving the meal plan, you will be entitled to a full refund of paid amount.

7. Complaints and Refunds

7.1. Grounds for Complaint

You can file a complaint only in the following cases:

  • Meal plan not delivered within 24 hours (if the problem is on our side)
  • Technical problems with downloading or opening PDF document
  • Obvious errors in content (e.g., incorrect calorie calculations, missing plan parts)
  • Plan doesn't match entered data you specified in questionnaire

7.2. What is NOT Grounds for Complaint

You cannot complain about the service due to:

  • Subjective dissatisfaction with recommended food taste
  • Change of mind after receipt
  • Insufficient results (weight loss/gain)
  • Personal health problems that occur during plan implementation (you must consult with a doctor)

7.3. Complaint Procedure

  1. Contact us at [email protected]
  2. In the message state:
    • Order number (OID)
    • Detailed problem description
    • Evidence (screenshot, messages, etc.)
  3. File complaint no later than 7 days from receiving meal plan

7.4. Complaint Response Time

We will respond to your complaint within 48 hours and propose a solution:

  • Plan correction
  • New plan creation (if error is ours)
  • Refund (in justified cases)

Final response and complaint resolution within 15 days from receipt of complaint.

7.5. Refunds

Refund is possible ONLY in the following cases:

  • You withdrew before delivery of meal plan
  • Plan not delivered within 24 hours due to problem on our side
  • Plan contains obvious errors we cannot correct

MANDATORY - Refund Method:

In accordance with OTP Bank Serbia requirements, in case of refund, refund is made exclusively via payment cards (VISA, MasterCard, Maestro, Dinacard), to the payment card account from which payment was made, by reversing the original transaction.

Refund timeframe: 14 days from acceptance of refund request

8. Liability and Limitations

8.1. Our Liability

We guarantee that:

  • Meal plan will be created by a certified nutritionist
  • Plan will be personalized based on data you provided
  • Plan will be delivered within 24 hours
  • All information in the plan is based on current scientific knowledge in nutrition

8.2. Limitation of Liability

⚠️ IMPORTANT - Medical Statement:

The meal plan we create is NOT a substitute for medical advice from your doctor. Before implementing any meal plan, especially if you have health problems (diabetes, heart disease, thyroid disorders, allergies, etc.), YOU MUST CONSULT WITH YOUR DOCTOR.

We are not responsible for:

  • Health complications that occur during or after implementing meal plan
  • Lack of results (weight loss/gain) - results depend on many factors (genetics, plan adherence, physical activity, metabolism, etc.)
  • Allergic reactions to foods you didn't mention in questionnaire
  • Worsening of existing health conditions if you didn't consult your doctor
  • Technical problems with your devices or email service preventing receipt or opening of PDF
  • Incorrect information you provided when filling out questionnaire

8.3. Your Responsibility

You are responsible for:

  • Accuracy of data you enter in questionnaire
  • Mentioning all allergies and intolerances
  • Consulting with doctor before starting plan implementation
  • Proper plan implementation
  • Listening to your body's signals - if you feel any discomfort, stop implementing plan and contact doctor

9. Intellectual Property and Sharing Prohibition

9.1. Copyright

All personalized meal plans we create are our copyrighted work and protected by Copyright and Related Rights Act.

9.2. Personal Use

The meal plan you receive is intended exclusively for your personal use.

STRICTLY PROHIBITED:

  • Sharing plan with other people
  • Publishing plan on internet or social networks
  • Selling or commercial use of plan
  • Copying and distributing plan in any form

Violation of these provisions constitutes copyright infringement and is subject to legal sanctions.

9.3. Exception

You may share the plan with your doctor or nutritionist for consultation purposes about your health and nutrition.

10. Data Protection

Protecting your personal data is our priority. Detailed information on how we collect, use and protect your data can be found in our Privacy Policy.

Most important:

  • Your health information is strictly confidential
  • We use data only for creating your plan
  • We do not share your data with third parties (except as legally required)
  • We keep data for 2 years in accordance with law

11. Dispute Resolution

11.1. Amicable Resolution

In case of any disagreement, before taking any legal steps, we invite you to contact us so we can try to resolve the problem amicably.

11.2. Consumer Organizations

As a consumer, you have the right to contact consumer protection organizations:

National Consumer Organization of Serbia (NOPS)

11.3. Out-of-Court Dispute Resolution

Consumers can also use the out-of-court consumer dispute resolution system through the European Commission platform: https://ec.europa.eu/consumers/odr

11.4. Competent Court

If amicable dispute resolution is not possible, the materially and territorially competent court is the court in Kruševac, Republic of Serbia.

11.5. Applicable Law

These Terms of Use are governed by the law of the Republic of Serbia.

12. Changes to Terms of Use

We reserve the right to change these Terms of Use at any time.

12.1. Notice of Changes

  • You will be notified of all changes by publishing a new version on the site
  • Changed terms take effect on the date of publication on the site
  • You can always check the date of last change at the bottom of this page

12.2. Impact on Existing Orders

Changes to Terms of Use do not affect already ordered and paid services. They are subject to terms that were valid at the time of ordering.

13. Final Provisions

13.1. Entirety of Contract

These Terms of Use, together with the Privacy Policy, constitute the entire contract between you and us.

13.2. Invalidity of Individual Provisions

If any provision of these Terms of Use is determined to be null or unenforceable, this does not affect the validity of other provisions.

13.3. Waiver of Rights

Our non-enforcement or non-use of any right from these Terms of Use does not constitute a waiver of that right.
